ARTELATAM, LLC. (“we” or “us”) owns and operates the website at ARTELATAM.ORG (the “Site”), where you can find information about our products and services. These Website Terms and Conditions (the “Website Terms”) describe the rights and obligations of an unregistered website user or visitor (“user” or “you”) in connection with your use of the Site. By accessing or using the Site in any way, including as an unregistered website visitor, you agree to be bound by these Website Terms and our Privacy Policy, which is available on the Site.

These Website Terms apply only to your use of the Site, and the content made available on or through the Site, as an unregistered website user or visitor. If you use or access any of our physical space, restricted-access web-based services (i.e. those requiring a login), the broker or referral program or other services we provide, your use of such space, services, or program is subject to the terms and conditions you received or accepted when you signed up for such space, services, or program. From time to time, we may make modifications, deletions or additions to the Site or these Website Terms. Your continued use of the Site following the posting of any changes to the Website Terms constitutes acceptance of those changes.

Eligibility

The Site and services it describes are available only to individuals who are at least 18 years old, unless otherwise specified. No one under this age may access or use the Site or provide any personal information through the Site.

User Submitted Materials

Any materials submitted by you including, without limitation, photographs, images, text, graphics and other materials (collectively, “User Submitted Materials”) are subject to the following terms and conditions:

You will maintain ownership of such User Submitted Materials, and you grant us and our designees a worldwide, non-exclusive, transferable, royalty-free, perpetual irrevocable right and license, with right of sublicense (through multiple tiers), to use, reproduce, distribute (through multiple tiers), create derivative works of and publicly display such User Submitted Materials solely in connection with the production or provision of any product or service requested by you or to demonstrate how your User Submitted Materials would appear in our products or services.

Content

The text, images, videos, audio clips, software and other content generated, provided, or otherwise made accessible on or through the Site (collectively, “Content”) are contributed by us and our licensors. U.S. and international copyright laws protect the Content and the Site. Our licensors and we retain all proprietary rights in the Site and the Content made available on or through the Site, and, except as expressly set forth in these Website Terms, no rights are granted to any content. Subject to these Website Terms, we grant each user of the Site a worldwide, non-exclusive, non-sub licensable and non-transferable license to use (i.e., to download and display locally) Content solely for viewing, browsing and using the functionality of the Site. All Content is for general informational purposes only. We reserve the right, but do not have any obligation to monitor, remove, edit, modify or remove any Content, in our sole discretion, at any time for any reason or for no reason at all.

Please note that while you retain ownership of your User Submitted Materials, any template or layout that we use to arrange such User Submitted Materials through tools and features made available through our Site are not proprietary to you, and all right, title and Interest to such template or layout will remain with us.

You represent and warrant that you are the owner of or otherwise hold all necessary rights with respect to the User Submitted Materials, and that the User Submitted Materials will not and will not infringe, misappropriate, use, or disclose without permission or otherwise infringe any copyright, Trade secret right, or other intellectual property or other property of any third party, and that the User Submitted Materials are not unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene, or otherwise objectionable.

You agree that we may (but are not obligated to) filter any User Submitted Materials (including, without limitation, deleting or replacing expletives or other harmful or offensive language), refuse to use any User Submitted Materials (including, without limitation, suspending processing and shipping of any order relating to any User Submitted Materials) and/or disclose any User Submitted Materials and the circumstances surrounding the use thereof, to any third party in order to provide the relevant products or services, to enforce these Terms or to fulfill any legal obligations or governmental requests.

Without limiting any of your other indemnification obligations contained herein, you agree to indemnify and hold us, our directors, officers, shareholders, employees, contractors, agents, representatives, affiliates, and third party users harmless from and against any and all claims, causes of action, liabilities, damages, losses, expenses and costs (including, without limitation, attorneys’ fees) that arise directly or indirectly out of or from: (I) your violation of these Terms, any other agreement or terms of use with us, any representation or warranty contained herein or therein or any applicable law; (II) your behavior in connection with obtaining any products or services from us; (III) your User Submitted Materials; or (IV) any activity related to access to or use of your account by you or any other person.

User Submitted Materials that violate these Terms may be removed from our Site; provided, however, that we are not obligated to remove User Submitted Materials in response to user reports or requests. We are not responsible or liable for the removal or non-removal of any User Submitted Materials from our Site. We strongly urge you to keep back-up copies of your User Submitted Materials on your hard drive or other personal system.

While we are not required to review User Submitted Materials for copyright infringement, we are committed to protecting copyrights and expect users of our Site to do the same. The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that content appearing on the Internet infringes their rights under U.S. copyright law. If you think in good faith that any content used or presented on or through our Site infringes your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it restricted. The notice must contain the following information:

Disclaimer; Limitation of liability

To the extent permitted by law, we and our affiliates, parents, and successors and each of our and their employees, assignees, officers, agents and directors (collectively, the “ARTELATAM, LLC. Parties”) disclaim all warranties and terms, express or implied, with respect to the Site, Content or services (including third party services) on or accessible through the Site, including any warranties or terms of merchantability, fitness for a particular purpose, title, non-infringement and any implied warranties, or arising from course of dealing, course of performance or usage in trade. In no event shall ARTELATAM, LLC. Parties be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the Site for (a) any special, indirect, incidental, punitive, compensatory or consequential damages of any kind whatsoever (however arising) or (b) damages in excess of (in the aggregate) US$100.

Miscellaneous

If any provision of these Website Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Website Terms shall otherwise remain in full force and effect and enforceable.

In order for any waiver of compliance with these Website Terms to be binding, we must provide you with written notice of such waiver. The failure of either party to enforce its rights under these Website Terms at any time for any period will not be construed as a waiver of such rights.

Pedro Felipe Vintimilla

Art Director Programs

His practice in art making, art education, and culture care. Born in Ecuador and based in Queens, mediums like papermaking, textiles, and digital imagery allow him to reflect on personal questions of cultural identity, immigration, gender, and belonging.

In 2012, he develops a laboratory of experimental and multidisciplinary artistic processes. This led him to focus on community projects with different organizations in the US and South America. In 2018 he receives a master’s degree in Fine Arts and Social Practice. In 2022 he is invited as an advisory member in 'The Art of Engagement', a research project organized by the University of Middlesex in London and the Tate Museum. This project investigates collaborative platforms between higher education and cultural institutions to strengthen the teaching of art as a social practice.

His work has been exhibited at the Queens Museum-New York, Museo de Arte de Nogales-Mexico, and Casa del Artista-Ecuador. Pedro Felipe is an Adjunct Assistant Professor of Art Education at City College - CUNY, and of Studio Art at Connecticut State Community College – Norwalk. Connecticul State Community College – Norwalk.

Melissa Montalvo

Project Assistant

Bilingual professional from Ecuador with office management experience. Self-motivated and detail-oriented personal assistant with excellent communication skills. Proficient in organizing tasks and coordinating appointments as well as customer communications and coordinate appointment schedules.

Provide support in the promotion of marketing and business services.

Sylvia Mata

President and Co-Founder

She has an MBA from The Business Institute in Madrid, Spain. She also has a degree in Economics and a BA in Statistics, both from the Central University of Ecuador. She is the National Commissioner of the North East Women for The League of United Latin American Citizens (LULAC) and President of the LULAC Council for Education in Queens, New York. Sylvia has vast experience as an executive for more than twenty years in Business Services, Non-Profit organizations, and Public Institutions in Latin America and the United States.

Carlos Torres Machado

CEO and Co-Founder

He has a BA in Contemporary Art and Communication with studies in Photography and Psychology of the University of San Francisco de Quito, Ecuador and the University of Arts from Buenos Aires, Argentina. Torres Machado is a visual artist and independent art curator who received the Award New York Regional Award in 2017 by the Bombay Sapphire Artisan Series and awarded have awarded art residencies at the Brooklyn Art Space (2016) and the Bushwick Generator (2020). In 2018, he was named President of the League of United Latin American Citizens. (LULAC) for the Brooklyn Art and Culture Council, New York. LULAC.

Nancy Rodríguez

Operations Manager

She has a Master's Degree in Skills Development from the Complutense University of Madrid, and a Bachelor's Degree in Business Administration from the Technological University of Santiago, Dom. Rep. (UTESA). She is an Organizational Consultant with more than twenty (20) years of experience in Human Management, Strategic Project Planning, and Organizational Development in different national and international companies such as Grupo M-Zona Franca, and Sivory Punta Cana, among others. She is a member of the Board of Directors of the Dominican Association of Human Management, and she was a teacher at the Pontificia Universidad Católica "Madre y Maestra" (PUCMM), and at the University of Continuing Education (UAPA).

Pamela Espinal

Community Manager

She has a degree in Social Communication, graduated from the Technological University of Santiago (UTESA, Headquarters). Professional Announcer, graduated from the Cibao Voice Over School in Santiago, Dominican Republic.

Professional Announcer licensed by the Ministry of Culture and the National Commission of Public Entertainment and Radiophony (CNEPR), Dominican Republic.Skills in conducting and producing radio and television broadcasts, Journalistic Writing, Planning creative content for social networks.

Jovanny Dilone

Web developer

He is a Venezuelan Systems Engineer, graduated from the Bolivarian University of Venezuela (UBV) in Caracas, Venezuela. With more than 8 years of experience in development and design of web pages, graphic design and digital marketing.
Founder and manager of the company Dilone System; which is currently in charge of making improvements, develop, optimization and maintenance to the ArteLatAm website.

Carlos Rojas

Art Curator and Critic, ArteLatAm Ecuador

Doctor in Latin American Cultural Studies. Professor of Aesthetics at the University of Cuenca and University of Azuay. National and international curator of several editions of the International Biennial of Cuenca, Ecuador. Curator of national and local exhibitions in Ecuador. Curator for four editions of the Paris Salon of the French Alliance in Lima, Perú. Curator of the Mariano Aguilera National Hall of the Municipality of Quito, Ecuador. Curator of the July Hall of the Municipality of Guayaquil, Ecuador. Collaborator of Anaconda and El Apuntador cultural magazines. Several publications on art and aesthetics, especially three volumes of Cannibal Aesthetics.

Alexis Mendoza

Art Curator and Critic, ArteLatAm New York

Cuban-born Bronxite Alexis Mendoza is an interdisciplinary artist, independent curator, and author. Mr. Mendoza had curated projects in museums and galleries around the world in countries such as: Argentina, Brazil, Chile, Costa Rica, Cuba, England, France, Germany, Mexico, Netherlands, Peru, Romania, Spain, Switzerland, and United State. Co-founder and co-creator of the Bronx Latin American Art Biennial project that evolved into the New York Latin American Art Triennial (Active Chief Curator); Founding member of BxArts Factory; currently he is the Artistic Director of Tabula RaSa NYC Theater and Performance Lab, New York. Alexis Mendoza is also the author of books, such as: “Latin America, The Culture and the New Men” (2007); “Objective Reference of Painting: The work of Ismael Checo, 1986-2006” (2006); “Reflections: The Sensationalism of the Art from Cuba” (2009); “Dear Democracy” (2019). All four published by Wasteland Press; and Rigo Peralta: Revelaciones de un Universo Mistico (2010), publish by Argos Publications, Dominican Republic. Alexis Mendoza lives and works in The Bronx, New York.

Miguel Ángel Muñoz

Art Curator and Critic, ArteLatAm México

He is a poet, historian, and art critic. He studied history at the National School of Anthropology and History, and completed a master's and doctorate in Art History at UNAM. His dedication to current artistic creation is absolute, he works in press media (El Financiero, La Jornada Semanal, Crónica) and as an art curator. He has worked with many artist like Eduardo Chillida, Rafael Canogar, José Luis Cuevas, Josep Guinovart, Roberto Matta, Antoni Tàpies, Richard Serra, Chema Madoz, Ignacio Iturria, Albert Ràfols-Casamada, Robert Rauschenberg and Luoise Bourgeois.

Mariojosé Ángeles

Art Curator, ArteLatAm Dominican Republic

Since 1997, in parallel to his professional career as an artist, he has been curating and organizing events and exhibitions, decentralizing the culture of traditional spaces in the Dominican Republic. Among which stand out, the Festival "ARTE TOTAL'' in 1997, 98 and 99, held in the city of Jarabacoa, Dominican Republic. From 2001 to 2005, he held the position of Cultural Affairs Attaché to the Kingdom of Belgium, the Kingdom of the Netherlands, and the European Community, organizing multiple art exhibitions and becoming a founding member of the Ibero-American Forum in Europe, at the Cervantes Institute in Brussels. In 2015, 2016, and 2018, he was the organizer and art curator of the group exhibitions, “DONE HERE”, in commemoration of World Art Day, at Casa de la Cultura de La Vega, Museo de Arte Sacro, and Museo del Carnaval Vegan, held in the City of La Vega, Dominican Republic. In 2017, “IMAGINACION EMPAPELADA'', Yoryi Morel Room, at the Cultural Center of Santiago, Dominican Republic. In 2019, “BYBLOS” on the occasion of World Book Day, a curatorial project held at the Pontificia Universidad Católica Madre y Maestra, in Santiago de los Caballeros, Dominican Republic. He is currently the art curator and organizer of the collective exhibition "MASCARILLA'', whose central theme is the Covid-19 pandemic.

Ana María Trujillo

Art curator, ArteLatAm Miami and Colombia

A B.A. in Visual Arts from the School of Arts and Letters, with Museum and Curatorial Studies, Photography, and Culture Management Minors from the National University of Colombia. Ana is currently the manager of the Arts and Culture department in Chia, Colombia. She has an artistic background of more than twenty years of experience working with non-profit organizations and also, she has been an advocate of social programs against violence in Colombia. Additionally, she was a Photography Professor at La Sabana University in Colombia. As an artist, she has several international exhibitions and awards for her photographs and paintings, such as her inclusion in "The 100 Book" of the best 100 Photographs in Colombia and “The best ten Latin-American artists” exhibit in New York, 2012.

Melania Maldonado

Project Manager of Dance & Music Programs

Melania is an Ecuadorian mezzo-soprano singer, lyrical and popular, soloist. She is also a voice coach, with 28 years of experience teaching singing; she developed a musical-pedagogical plan with cultural and therapeutic activities for young people called "Music for Life." She works with students of different levels and styles at MelaniaMusic; Her private studio is located in the heart of Manhattan where she transmits her knowledge and experience to students from different parts of the world. She also provides her services to "Western Kentucky University" in the area of Latin American Music.

Melania with a 12-year career and constant work with the Latino community from LULAC (League of United Latin American Citizens), a non-profit organization, the largest in the United States with more than 94 years of service and fight for the civil rights of Latin American citizens. She leads LULAC NY Council #23199, Integrated Arts in Midtown Manhattan, focusing on cultural development for the Latin American community-based in New York through vocal, musical education, and art in general.

Santiago Robayo

Branding and Design Coordinator

Is a highly skilled Graphic Design Technologist based in Quito, Ecuador. He graduated from the Metropolitan Institute of Design and has amassed extensive experience in the design and advertising industry over the years. Starting as a Technical in Images at C.A. El Comercio in Quito, Ecuador, Santiago honed his image manipulation skills. He then moved on to serve as an Art Director at Rivas Herrera Young&Roubicam, where his creativity and visual prowess shone through in numerous projects.

Throughout his career, Santiago has held roles such as Creative Art Director at Lowe-Delta Publicidad and Art Director at TBWA, showcasing his ability to create visually compelling content. He has also freelanced as an Art Director for various brands and agencies including Maruri Gray, Publicis Ecuador, and El Santuario.
